  1. It is not just the Supreme Court, but other federal courts. During the first three years of Obama's term, the Senate has confirmed 97 of Obama's district court nominees and 25 of his circuit court picks, giving the President 41 fewer district judges and four fewer circuit court appointees than President George W. Bush had at this point in his presidency.
    The influence of lower courts is just as concerning as the Supreme Court.
    BTW : Obama has appointed a record number of women to the bench ... so in a Romney-era, there might be a "binder of men" so that Romney can correct Obama's "mistake".

    The Supreme Court has not been a topic during this election season, but one area has : regulations. Regulations are handled by administrative and semi-judicial functions ... that is Congress's target ... consider Chairman Kline's attack on the National Labor Relations Board.

    The influence of the Bush regulators and judges will be experienced for years.
